TERMS OF TRADE


Acceptance of these Terms of Trade

You will be deemed by your conduct to have accepted these Terms of Trade if you ask Level Ridge Limited verbally, or in writing (including texts) to commence works at your property and/or you pay any required deposit.

If you do not accept these Terms of Trade, you must let Level Ridge know before 5pm, the day before the job is scheduled to commence.

Validity and Acceptance of Quotes

Our quotes are valid 30 days from the date stipulated on the quote. 

Quotes are subject to any increases in the cost of materials or services from suppliers and sub-contractors after 30 days.

Where a PC Sum is included, this means that Level Ridge cannot predict the end cost of a job involving another contractor, therefore any flexibility in that contractor’s end charges is to be expected and paid for by the client.

Any additional work requested by the client, after a quote has been accepted, will incur extra charges as stipulated and agreed to within a separate Variation document. 

If a quote is not signed by yourself, you will be deemed by your conduct to have accepted these Terms and Conditions if you ask Level Ridge Limited verbally or in writing to commence works at your property and/or you pay any required deposit.

 

Payment Terms

For jobs costing over $5,000, a 30% deposit must be made prior to the commencement of the job.  An invoice will be given at the end of each stage of the job, with payment in full expected before the commencement of the next stage of the job.

Payment is due without any retention 7 working days following the date of service of our invoices/payment claims (“the Due Date”). 

Any payment schedule must be provided to Level Ridge Limited no later than 5 working days following the date of service of the payment claim. 

If you do not make payment by the Due Date, you shall be liable to pay:

  • default interest at the rate of 1.5% per month, which shall accrue on a daily basis on the total amount outstanding from the Due Date to the date of payment in full, and

  • any legal costs on a solicitor/client basis that we incur incidental to the enforcement or attempted enforcement of our rights, remedies and powers under these Terms and Conditions.

Level Ridge Limited shall be entitled to immediately and without notice suspend any further work on credit if any payment is not made by the Due Date.  Such suspension shall have the same effect and be on the same terms as that set out in s24A(2) to (5) of the Construction Contracts Act 2002.

Payment Claims

All payment claims by Level Ridge are made in accordance with section 20 of the Construction Contracts Act 2002.

Delays

Level Ridge will not be held responsible for delays due to the inability to access the worksite, poor weather conditions, uncompleted work by other contractors, delayed delivery of materials by suppliers, or due to any other factors beyond our reasonable control.  Level Ridge will not be liable for any losses or costs resulting from these delays.

Workmanship

A repair or refund cannot be expected if workmanship has been completed to the best standard possible within the constraints of surrounding materials and space.  This applies especially to maintenance jobs in houses where the construction of existing walls and structures is uneven, or of poor quality.

Level Ridge takes no responsibility for damage to workmanship or surrounds caused onsite by other contractors either prior to, during or upon completion of the job.
